These terms cover your use of the ListRodeo site, a product of Atypical Artifacts LLC ("Atypical Artifacts," "we," "us"). By using the site or joining the waitlist you agree to them. If you do not agree, do not use the site. Questions: hello@listrodeo.com.

The site today

ListRodeo is a tool for resellers who list on eBay. This site is our brand page and waitlist. The listing tool is not yet open. Joining the waitlist lets us tell you when early access opens; it does not create an account or a paid subscription, and it is not an offer of the tool.

Eligibility

ListRodeo is intended only for adults 18 years of age or older. By using the site you confirm you are at least 18.

The waitlist

When you join the waitlist you give us an email address so we can contact you about early access. You can ask us to remove your address at any time. See ourPrivacy Policy for how we handle it.

Access

The site is provided as is while we build toward launch. We may change, suspend, or end any part of it at any time.

Acceptable use

Do not use the site to submit false or other people's information, to interfere with or misuse the site, or to break any applicable law.

Relationship with eBay

ListRodeo is an independent tool and is not affiliated with, endorsed by, or sponsored by eBay. eBay is a trademark of its owner. Your use of eBay is governed by eBay's own terms.

No warranty

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATYPICAL ARTIFACTS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, SALES, OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these terms limits or excludes liability for gross negligence, willful misconduct, or fraud, or waives any rights that cannot be waived under applicable law.

Dispute resolution and arbitration

Any dispute arising from or relating to these terms or the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in, and exclusive venue for any matter not subject to arbitration lies in, the state and federal courts located in Tarrant County, Texas.YOU AND ATYPICAL ARTIFACTS AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. This section does not apply to the extent applicable law does not permit it.

Termination

You may stop using the site at any time and ask us to remove your waitlist email. We may end your access if you break these terms.

Changes

We may update these terms. When we do, we will change the date at the top of this page.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.
